Cattarly <br />Division Director <br />Natural Resource Trustee <br />The Amendment application was filed on June 2, 2005. It was called complete on August 15, <br />2005. The applicant, Rocky Mountain Materials, proposed to add 253.63 acres to the existing <br />112-permit area of 41.37 acres, located approximately 3 miles South of Calhan, Colorado, <br />Section 22, Township 12 South, Range 62 West, and 6th Prime Meridian. The operator also <br />proposed to increase the affected acreage from the current 39 acres to 50 acres, for a net <br />increase in affected acreage of 11 acres. Twenty-six timely objections were received prior to the <br />close of the comment period. Of the twenty-six timely objections, sixteen were received before <br />the application was called complete and the first publication was printed on August 24, 2005. <br />Because it was determined by the Division, and agreed upon by the operator that the original <br />Public Notice might not have met the requirements of Rule 1,6.2 (1) (d), that required the <br />operator to publish a "Public Notice in a News Paper of General Circulation in the locality of the <br />proposed operation", the Division requested the operator to re-publish. The comment period <br />under the new public notice comment period ended on December 7, 2005. The Division received <br />two new comment s from objectors to the amendment and another objector sent the same <br />comment sent on October 7, 2005, after the close of the first comment period, with a new cover <br />letter. Since there were no new issues raised by the new objectors that are within the Jurisdiction <br />of the Division, the rationale to recommend approval of the amendment remains unchanged. <br />The current land use is rangeland. The proposed site will be restored to rangeland. Pit slopes will <br />be gratled to 3:1 slopes and re-vegetated with the rangeland seed mix as approved by the local <br />Soil Conservation District. <br />All aspects of the permit application meet the requirements of the Construction Materials Rules <br />and Regulations. <br />The Division of Minerals and Geology (DMG) hereby issues its recommendation for approval of <br />the Amendment to Sokol pit, File No.M-1980-193 based on the fact that the application meets all <br />the requirements of CRS34-32.5-101 to 125. <br />OFfirn of <br />Mined Land Reclamation <br />Office of <br />Active and Inactive Mines <br />.~ <br />Colorado <br />Geological Survey <br />
