The NOV was received on March 24, 1986. <br />In summary, NOV No. C-B6-022 was written for failure to moni- <br />tor ground water monitoring sites in accordance with the regula- <br />tions and the approved permit. The impetus for writing the <br />above-mentioned NOV was the Mined Land Reclamation Division <br />("MLRD") review of the 1985 Annual Hydrology Report submitted by <br />Kerr Coal Company ("Kerr"), and subsequent review of mine office <br />records during the joint Office of Surface Mining, Reclamation <br />and Enforcement <"OSMRE"), MLRD mine inspection conducted on <br />March 18, 1986. <br />The 1985 Annual hydrology report contained a thorough review <br />of Kerr's Hydrology monitoring program, which outlined the moni- <br />toring problems cited in NOV C-86-022 and proposed appropriate <br />•remedies to those problems. The MLRD review of the 1985 Annual <br />Hydrology report resulted in a letter to Kerr dated February 25, <br />1986, requesting specific information and remedial actions to <br />alleviate the monitoring problems, which differed from those <br />proposed in the 1985 Hydrology Report. Subsequently, Kerr pre- <br />pared and mailed to MLRD a response letter dated March 12, 1986, <br />which fully addressed the MLRD concerns with the ground water <br />monitoring program. In conjunction with the above-mentioned <br />letter, an in-house schedule for remedial action and 1986 Hydrol- <br />ogy Monitoring was prepared and distributed to the mine office <br />and Kerr's water monitoring consultant to affect the necessary <br />repair work and 1986 monitoring activities. On March 18, 1986, a <br />joint inspection of the mine and records was conducted by Steve <br />Renner of MLRD and Gary Fritz of OSMRE. During their review of <br />the mine office records, the above-mentioned report and letters <br />were examined and viewed by Mr. Renner and Mr. Fritz as the basis <br />
