Mr. Robert Hagen - 2 - July 2, 1991 <br />Small Area Exemptions - It was agreed upon at the meeting that more rigorous <br />demonstrations must be made by applicants for small area exemptions. Both <br />agencies agreed that decisions regarding approval or denial of the exemption <br />may be made using the best professional judgement of staff hydrologist after <br />thoroughly reviewing the relevent data and subsequent analysts. <br />Records; Permit Document Availability - We would like to clarify when <br />documents must be on file at a county courthouse. Unless a county courthouse <br />is the designated repository for permit documents, they do not necessarily <br />need to be on file at that location. However, when a permitting action is <br />pending the pertinent application materials do need to be on file at the <br />courthouse. Otherwise, records, documents and files must be available to the <br />public for review and copying in the vicinity of the mine site. This policy <br />is consistent with Director Snyder's 733 response. Our May 3, 1991 and May <br />14, 1991 correspondence regarding Ten-Day Notice X-91-02-244-7 more fully <br />discuss this issue. <br />I hope that these comments help to clarify the meeting notes, and serve to <br />update you.
