Re: Packet of Information for Citizen Participation in the Permit Application Frocess.
The enclosed packet of information is being sent to you because a written objection to the above-named
Construction Materials 112 permit amendment application was received from you, prior to the close of the public
comment period. The packet is intended to explain the application process, which includes actions and responses
performed by this office when timely objections aze received, as is the case here.
Your written objection, received by this office before the close of the public comment period, qualifies you to be a
"party" in this matter. Your party status entitles you to specific rights, and also carries with it certain
responsibilities. Please cazefully review the packet, as these issues aze fully explained therein.
Due to the receipt of the written objection, the Division's process of review of the amendment application now
must include two additional steps: apre-hearing conference and a formal public hearing. The pre-hearing
conference will be arranged to be held in Durango in about two weeks. After the pre-hearing conference officer
and a date have been confirmed you will be notified by mail. The formal public hearing will be held before the
Mined Land Reclamation Board at one of their monthly meetings in Denver. You will be provided notice of the
hearing also.
Please note that if you do not wish to remain as a party, you must complete and submit the "party status withdraw
form," found at the end of this packet. If you wish to remain as a party, but have another person represent you at
the pre-hearing conference or the forma] public hearing, you must complete and submit the "authorization to
represent a party" form, also found at the end of the packet.
