The Colorado Division of Minerals and Geology proposes to Approve with wnditions. Permit Renewal <br />Application No. 3 (RN-3), submitted by Blue Mountain Energy, Inc for a coal mining permit at the Deserado <br />Mme (Pemrit No. C-1981-018). The proposed renewal will allow for continued mining and/or reclamation <br />operations at the site. <br />Based on review of the cost to reclaim the worst case disturbance during the peimit term, the Division is <br />proposing a downward adjustment in the required bond amount, from the current Lability amount of <br />$7,102,512.00, to $5,052,786.00. The adjustment reflects modified reclamation procedures addressed in the <br />renewal application and the cost estimate, and recent updates to the Division's cost estimating software <br />which are based on various published cost estimating references. <br />The Deserado Mme is located in Rio Blanco County, appro>amately 7 miles northeast of Rangely, Colorado. <br />Coal interest at this underground mine is Federal, and the surface to be affected is Federal and private land. <br />The permit area encompasses apprortimately 10,829.00 acres. <br />This proposed decision is based on a Ending that the proposed operation will comply with all requirements of <br />the Colorado Surface Coal Muting Reclamation Act, Section 3433-101 et seq., C.RS., and the regulations <br />promulgated thereunder. <br />A copy of the "Proposed Decision and Findings of Compliance", including any stipulations, is on file for <br />public inspection at the Colorado Division of Minerals and Geology, Room 215 Centennial Building, <br />1313 Sherman Street, Denver, Colorado 80203, and at the Town Clerk's Office, Rangely Town Hall, 209 <br />East Main Street, Rangely, Colorado 81648. Persons with an interest that may be adversely affected by the <br />proposed decision and reclamation bond adjustment, may request a fom~al hearing before the Mined Land <br />Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the <br />initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for <br />the request and the objections to the proposed decision <br />~,~~ <br />-'dY:'. <br />NOTICE OF:PROPOSED DECISION <br />
