<br /> <br />Ms. Suzanne Benton <br />October 24, 1995 - Rio Grande <br />Page 2 <br />c) No Mine I.D. sign. <br />CORRECTIVE ACTION - install a mine I.D. sign. <br />Your September 12, 1995 letter stated that the signs are <br />on order and will be installed as soon as delivered. <br />Please notify the Division as soon as the sign is <br />installed so the problem can be abated. <br />d) No Performance Warranty on file. <br />CORRECTIVE ACTION - submit a properly completed <br />Performance Warranty document. <br />I sent you a copy of the document when I mailed the <br />inspection report. If you need another copy, please <br />call Lavern Lemay at (303) 866-3567. <br />e) Asphalt batch plant, scales and fuel tanks installed in <br />the permit area but not included in the approved permit. <br />CORRECTIVE ACTION - since the County is not required to <br />have a financial warranty on deposit, the Division will <br />allow you to make this change to your permit pursuant to <br />Rule 1.9 (Permit Technical Revisions). <br />You can submit your Technical Revision (TR) request in <br />letter form by providing a narrative as to the purpose <br />of the request (amending the existing permit) and <br />providing sufficient information about the equipment and <br />structures (dimensions, volume of fuel storage, etc.), <br />so the Division can complete a geotechnical evaluation. <br />Of particular interest, the Division will want to know <br />how you plan to protect groundwater from accidental <br />spills of fuel and asphalt mixture (e.g., install a clay <br />or synthetic liner, construct a berm around the <br />equipment and tanks sufficient to hold 133 of the fuel <br />and asphalt material stored or used on site, etc.). <br />The Division will want to know if Rio Grande County has <br />an emergency response plan, in case of an accidental <br />spill of fuel or asphalt mixture, including how the <br />spill will be cleaned up. In addition, a map of <br />sufficient size an scale showing the location of the <br />asphalt plant, fuel tanks and scale will be required. <br />Finally, pursuant to C.R.S. 34-32-127, a fee of $150, <br />will be required. <br />
