Box 591 <br />Lamar, Colorado 81052 <br />Re: Valco, Inc.'s "Lamar West Pit", Prowers County, File No. M-81-132 <br />Dear Mr. Gregg: <br />The May 23, 1985 formal public hearing addressed the possibility that Valco, <br />Inc. may have been in violation of the Mined Land Reclamation Act for failure <br />to salvage and stockpile topsoil at the Lamar West Pit. <br />It was disclosed that topsoil was indeed stockpiled at the Lamar West Pit <br />site; therefore, no violation was found. However, the issue concerning "the <br />stockpiling of adequate volumes of topsoil to reclaim the maximum disturbance <br />present at any point in time" was clarified. <br />The "Probable Violation Presentation Form" is being re-evaluated by the <br />Division's minerals staff. In the future, only actual violations and serious <br />compliance problems will probably be presented to the Board.
