The complaint is agitinst Mountain Coal Company's (MCC) West <br />Elk Ivfine, Colorado Division of Minerals and Geology (DMG) permit 80-007. The nature of the <br />complaint is surface impacts of subsidence to your property. <br />?'`' ~ '. :I contacted your attornry, Mr. Jon Ncbops, as we!digcussed on ]unc 24, 1997. Yesterday I spent .. .:. <~_ ~~li . <br />-about three hours at his ofTice revietvittg your file. He also allowed me [o make copies of some of <br />the many documents. The dowments I copied are mostly correspondence between you, MCC, <br />and DMG. Some of the documents could be useful for me in my discussions with DMG. I do not <br />know what documents you have provided DMG and MCC through the long life of this problem, <br />and (do not know if you consider any of the documents in the file confidential. As such, 1 would <br />like your written permission to use the file documents. If there are any documents you specifiratly <br />wish to keep confidential, please list those forme. As I said in our telephone conversation this <br />morning, i believe that most of the documents would be found in DMG's public files, but since I <br />got them from your attorney's files, I will need written permission. <br />The next step in this process is to meet with DMG and discuss its involvernent in the complaint. <br />' Mr. Dave Belly, whom I believe you know, is the supervisory inspector for this operation.
