Ms. Kathleen Sullivan <br />August 1, 2005 <br />Page 2 <br />CARVER KIRCHHOFF SCHWARZ McNA6 & BAILEY, LLC <br />Measures Taken to Comolv with Reclamation Reguirements <br />RMCC has completed sloping the existing area of mine disturbance and is preparing to <br />seed this fall as the weather allows. The area where the materials processing equipment was <br />localed (i.e., the crusher, screens, wash plant, stockpiles, etc.) has been left in its current <br />condition since such equipment will be relocated to the site in the near future. RMCC is in the <br />process of working with the Office of the State Engineer to update the substitute water supply <br />plan for the site to address the expected evaporative loss from open water in the limited mined <br />land excavation at the site. By this letter RMCC is requesting that the Division inspect Del <br />Camino to evaluate the reclamation steps RMCC has taken for purposes of satisfying this <br />element of the temporary cessation requirements. Bill Timmons, RMCC's General Manager, <br />Aggregate Operations, will call you shortly to schedule an appointment to meet you at the site <br />for the inspection. If you need to reach Bill directly, his cell telephone number is 303-668-1751. <br />Adegugcv of Existing Financial Wgrrgnfv <br />As a condition of the recently approved Transfer of Permit and Succession of Operator, <br />RMCC posted a replacement reclamation bond, which was approved as a condition of the <br />transfer and succession. The outcome of the site inspection RMCC is requesting should allow the <br />Division to determine whether the bond is adequate in light of the temporary cessation. <br />Should you have any questions regarding this Notice, or require assistance in getting in <br />couch with Bill Timmons, please do not hesiiaie to call me.
