Long <br />2 <br />MI.RD's response indicates that all three of the areas where runoff was <br />allowed to flow onto the waste pile noted in the violation were re- <br />inspected on March 8, 1990. Tha[ inspection demonstrated that the three <br />conditions noted in the TDN were corrected so as to effectively route <br />runoff into the 100-year diversion ditch located around the eastern and <br />southern perimeters of the pile. The surface-water runoff from the fill <br />and area above the fill is now properly directed to the appropriate <br />diversion channel. Therefore, the violation as cited in the TDN no <br />longer existed and no enforcement action was required by MLRD. <br />AFO finds MLRD's response to violation 1 of 1 of this TDN to be good <br />cause for not taking action and finds it to be appropriate. <br />Sincerely, <br />
