Cattany <br /> <br />subject: NOV C-2006-006, C-1982-056 Division Director <br />Natursl Resource Trustee <br />date: September 25, 2006 <br />The subject NOV (unintentional dischazge of coal fines into Foidel Creek) was issued (registered <br />mail) on 19 September 2006. The violation was observed during a Division inspection of 13 <br />September 2006. A buried coal fines thickener underflow pipe that conveys coal mine waste <br />materials from the wash plant to disposal underground (as permitted in the Permit Application <br />Package) ruptured. The thickener 7mderflow (slurry) rose in an access riser and was dischazged <br />into Sedimentation Pond E. Dischazge (slurry) from Sediment Pond E entered Foidel Creek. The <br />dischazge of slurry into Pond E, and the dischazge of sluury into Foidel Creek, aze not permitted <br />in the Permit Application Package. <br />Please find attached the NOV file.
