Interstate 25 <br /> Castle Rock, Colorado 80104 <br /> Re: Douglas Pit - File No. 83-89 <br /> Dear Mr. Smythe: <br /> Action by the Colorado Mined Land Reclamation Board during a formal public <br /> hearing on February 27, 1985 resulted in their issuing the enclosed Notice of <br /> Violation and Cease and Desist Order applying to the operation described <br /> above. The Cease and Desist Order requires an immediate cessation of all <br /> mining and mining-related activities at the Douglas Pit and is to remain in <br /> effect until such time as a replacement financial warranty in the amount of <br /> $5,000.00 is received and approved by our Division. <br /> Furthermore, the Board ordered this matter to be conditionally set for another <br /> formal public hearing to be held during the meeting of March 27-28, 1985, if <br /> an adequate replacement financial warranty has not been received by that <br /> time. This hearing would be held in Room 110 of 1313 Sherman Street, and the <br /> Board convenes their meetings at 9:00 a.m. , each day. You may call our <br /> office during the period of March 25-26, 1985 to get a more specific day and <br /> time for the hearing. This hearing would be held to discuss possible civil <br /> penalties as set forth in C.R.S 34-32-124(7), which states: <br /> "Any person who violates any provision of any permit issued under this <br /> article shall be subject to a civil penalty of not less than one <br /> hundred dollars per day nor more than one thousand dollars per day for <br /> each day during which such violation occurs; except that any operator <br /> who operates under a permit issued under section 34-32-110 shall be <br /> subject to a civil penalty of not less than fifty dollars nor more than <br /> two hundred dollars per day for each day during which such violation <br /> occurs." <br /> 423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
