Responses from the public <br />to your newspaper advisement were due at the Division on August 9, 2006. Responses to <br />completion letters from the Division to interested persons and agencies were due at the <br />Division on August 5, 2006. Please respond to the following adequacy items, as indicated <br />in bold. <br />Item 1. Rule 2.05.2(2)(6). The reclamation cost estimate provided in the application is <br />less than the Division estimate. Please find attached a Division interoffice memorandum <br />to Byron Walker from Janet Binns dated 8/23/2006. Please reconcile the difference, and <br />submit a revised estimate, or accept the Division estimate, for inclusion in the <br />application. <br />Item 2. Rules 4.03.1(1)(a), 4.03.1(1)(6), 4.03.1(3)(d)(ii), 4.03.1(3)(e)(x), 4.03.1(4)(b)(ii). <br />No description of temporary sediment control measures were found in the PAP for the <br />proposed work. Please incorporate the use of temporary sediment control measures <br />(sediment booms, silt fences, mulching, etc.) until the disturbed surfaces are <br />stabilized. <br />Item 3. Rule 4.03.1(3)(a)(iii) No pitch grade exceeds 15%; but, as recognized on page <br />2.05-70 of the application, pitch grades exceed 10 percent for 500 feet. In support of the <br />statements regarding temporary summer and fall use (line 11, page 2.05-70), please <br />include a thorough analytical demonstration by a qualified registered professional <br />engineer that such alternatives will be as environmentally sound as those resulting <br />from haul roads complying with the requirements of 4.03.1(3) and that the <br />alternatives meet such other criteria as are necessary to achieve reclamation in <br />Office of Office of <br />Mined Land Reclamation Active and Inactive Mines <br />
