BANTA, Director < <,~~"~~ ~`~ <br />January 24, 1989 -~~-~ <br />Mr, Charles Baldwin <br />Baldwin Construction <br />C/0 Holiday Inn <br />Trinidad, Colorado 81082 <br />RE: Trinidad Basin Mine (C-81-048) <br />Dear Mr. Baldwin: <br />In early 1988, your company began construction of access roads for a <br />residential development in Del Agua Canyon. As you know, some of this <br />development is on property which is part of the presently reclaimed <br />Trinidad Basin Mine. The Division recognizes the fact that you are the new <br />surface owner of at least the part of the mine where this construction has <br />taken place. However, during construction of the roads, your company <br />redisturbed land which had been previously reclaimed by the mine operator, <br />Vance Mills. Mr. Mills presently is under a bonded liability for the <br />successful reclamation of the property, including the area where the roads <br />were constructed. This bond is in effect for at least 10 years from the time <br />of successful reclamation. Obviously this creates a conflict of interest in <br />regard to the present use of the property. Therefore, we expect that Mr. <br />(tills will attempt to petition the Mined Land Reclamation Board to chanoe the <br />land use designation from rangeland to residential land use. In conjunction <br />with this action he will probably petition the Board to exclude the <br />redisturbed land from his permit area, thereby relieving him of his bond <br />obligation on the redisturbed area. <br />Before he pursues this action the Division would like to hold a meeting with <br />you and Mr. Mills to discuss various issues including exactly how much of the <br />mine you own, any planned future disturbances, and any problems you might have <br />concerning this issue. In order to vet this item on the February Board <br />Agenda, we would like to hold this meeting between now and February 10, 1989 <br />We are available to meet any time and could travel to Colorado Springs or <br />Trinidad if necessary. We have notified Mr. Mills of the intended meeting and <br />he should be in contact with us soon. Since he has the greatest distance to <br />travel, we would like to remain flexible around his schedule. Would you <br />please let us know if you can accommodate a flexible schedule or what dates, <br />times, and locations would work for you.
