<br />-z- <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the Colorado Mined Land Reclamation Board hereby finds <br />L. Otto Goemmer to be in violation of Permit M-82-129, specifically Exhibits B <br />and C, and C.R.S. 34-32-116(7)(h). <br />CEASE AND DESIST ORDER <br />Based upon these same Findings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders L. Otto Goemmer to: <br />1. Cease and desist from conducting the following mining operations at the <br />Rocky Flat Gravel Pit - P~armit M-82-129: all mining activities in areas <br />outside of the affected (permit) land boundary except removal of existing <br />stockpiles and other reclamation activities until such lands are added to the <br />permit by amendment or conversion. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1> of <br />this Cease and Desist Order. <br />3. Complete at your option one of the following corrective actions: <br />a. Provide the Division a survey of all lands disturbed by mining <br />activities. The survey should be prepared by a registered surveyor. <br />Submit by May 25, 1994 an amendment or a conversion (whichever the <br />survey shows to be appropriate) to Permit M-82-129, which will include <br />all affected Iand within a corrected permit and affected land boundary. <br />If amended, approval should be obtained within 60 days of submittal. If <br />converted to a 112 permit, approval should be obtained within 120 days <br />of submittal. <br />b. An option to (a) above is to completely reclaim all lands disturbed by <br />mining related activities outside of the present permit boundary by <br />June 26, 1994. Reclamation shall be completed to the standards of Rule 6 <br />except for final growth of established vegetation. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />
