<br /> <br />Mr. Earl Lawrence - 2 - May 30, 1985 <br />STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: ) NOTICE OF VIOLATION M-85-040 <br />AND <br />Mr. Earl Lawrence, dba ) CEASE AND DESIST ORDER <br />Lawrence Construction <br />T0: Mr. Earl Lawrence and all other persons engaged in or owning or <br />controlling the following operations: Lawrence Pit - Douglas County <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land <br />Reclamation Board by C.R.S., 34-32-124, the Board hereby makes the following <br />findings of fact: <br />1. Mr. Earl Lawrence is conducting a mining operation at the following <br />locations: <br />Sl/2 SE1/4 Sec. 29 T6S, R68W of the 6th P.M. <br />2. The operator has failed to salvage and protect topsoil pursuant to <br />34-32-116(1)(G). <br />3. Mining has occurred below and to the east of elevation 5560 which <br />is spec ifical]y prohibited by the permit. <br />4. The operator has failed to minimize disturbance to the hydrologic <br />balance pursuant to 116(1)(H). <br />5. Silted water was directly discharged into Plum Creek and in <br />violation of the approved mining and reclamation plan, the operator <br />constructed a settling pond. <br />
