POWDERHORN
COAL COMPANY
January 23, 1995
Mrs. Susan J. McCannon
Coal Program Supervisor
Colorado Division of Minerals and Geology
1313 Sherman Street, Room 215
Denver, CO 80203-2273
RE: Notice of Violation C-95-001, File C-81-041
Dear Mrs. McCannon:
III IIIIIIIIIIIIIIII
898
P.O. Box 1430
Palisatle, Colorado 81526
(303)4647951
Fax (303)464-7161
GE~~~~
~~ 19g5
~~~ 2 ~ ~eo~o9'1
O\ ~1\pG\~a\5 tr
0\~\5\..
In accordance with Rule 5.04.3(1) additional information is being
submitted to assist in evaluating an assessment on the subject
NOV.
The lower three benches of the Cameo Refuse Disposal Area No. 1
were covered and seeded during the summer of 1994. The top of
each bench is 10 - 15 wide, sloped to the inside approximately 5$
and sloped to collection ditches on both ends at approximately
2$. The top of the benches were staked for drainage during the
cover project and the design drainage grades were met overall.
Minor problems were later found at the end of some of the
benches. We had a backhoe out in November to work on drainage.
Due to the mud the hoe was not able to establish the final grade
but did assure drainage to the collection ditch. We understood
at the time that a dozer would be needed in the spring to smooth
the benches and eliminate the small puddles that were not
drained. In the mean time the puddles could trap sediment.
At the time of the inspection there were puddles on the two
benches in question but they were filled to capacity and the
second bench had a small trickle of water overflowing to the
collection ditch. Both benches were sloped to the inside such
that design flows would be contained on the sloped bench and
routed past the puddles to the collection ditch. The puddles
has a maximum depth of 6~~ and the largest one may have contained
100 gallons of water. We believe the benches were being drained
to the 100 year collection ditch and that the puddling would
present little environmental harm until spring when the benches
were thawed and dry.
Thank-you for your consideration of our input.
Sincere ,
~~~r~:~
Larry M.
