Walker Natural Resource Trustee <br />cc: Dan Hernandez, Sandy Brown (both by a-mail) <br />subject: Bowie No. 2 Mine, Permit Number C-1996-083, Bowie Resources LLC Technical <br />Revision No. 44, West Expansion of Gob Pile No. 2, Adequacy Review <br />date: January 3, 2007 <br />This memorandum is in response to your request (memorandum of January 2, 2007, subject as above) for <br />review of adequacy responses and advice concerning a request by the applicant to start depositing coal <br />mine waste in Gob Pile 3 before the results of geotechnical investigations are available in support of <br />Technical Revision (TR) 44. A stipulation is proposed for the provision of the required geotechnical <br />investigations. The request for advance disposal is urgent as the applicant is running out of room in the <br />approved disposal sites. This memorandum is supplemental to my memorandum of November 6, 2006, <br />wherein the Division has asked, among other information, for geotechnical investigations of ground <br />underneath Gob Pile 3 in support of the application for the proposed new gob pile. <br />No site visit was made by me for this review. Materials reviewed include your memorandum of January 2, <br />2007; J. E. Stover & Associates, Inc letter of December 26, 2006; geotechnical logs of Gob Pile # I Hole <br />WBH-B1 and Gob Pile Number 2 Hole #9; Figure 2.1 and Figure 2 (11/10/03); and Figure I (12-11-06 <br />and OS-16-OS); and photograph Nov 21, 2006. All materials supplied have been returned to your office. <br />The site has, from information provided by you, that the preparatory excavation work has been <br />accomplished. This work is illustrated on Figure 1, 05/16-05, of Technical Revision (TR) 43, and appears <br />in the photograph. You also advised, in your memorandum, that the applicant's consultant reported no sign <br />of springs or seeps in the excavated area. <br />Similaz materials are recorded in the drill logs of the two exploration holes mentioned above, WBH-Bl <br />and 9. These two holes bracket, on the east and one on the west, the proposed Gob 3 site. As such, and due <br />to the consistent geomorphology of the area, similar materials might be expected to be in the Gob 3 site. As <br />there are no springs or seeps in the area, I find it reasonable to permit restricted temporary placement of <br />coal mine wastes at the site pending approval of the design Gob 3 waste bank. <br />Restrictions should be (part of the stipulation): <br />I .that the elevation (height) of material over any portion of the site is not to exceed half the final design <br />surface elevation of the proposed waste bank (a factor of stability of 2 over the approved design), and in no <br />case be of greater elevation than the original (pre-disturbed) ground surface (i.e., no weight on any area <br />greater than that of the pre-disturbed site). <br />Office of <br />Mined Land Reclamation <br />Office of <br />Active and Inactive Mines <br />
