erosion. The Division therefore proposes to approve the use of the <br /> alternative specifications for the culverts on the extension of W 5th Street <br /> (4.03.1(4)(e)(vi)). <br /> II. Hydrologic Balance - Rule 4.05 <br /> A. Water Quality Standards and Effluent Limitations <br /> 1. The Division proposes to grant a small area exemption from use of <br /> sediment ponds due to the limited size of the area and due to the fact that <br /> ponds and treatment facilities are not necessary for the drainage to meet <br /> the effluent limitations of Rule 4.05.2 and applicable State and Federal <br /> water quality standards for receiving streams and also due to the fact that <br /> no mixing of surface drainage with a discharge from underground workings <br /> will occur. The small area to be exempted is located at the topsoil pile at <br /> pond 007 (4.05.2(3)(b)(i)). <br /> B. Acid-forming and Toxic-forming Spoil <br /> 1. The Division proposes to approve temporary storage of acid- and <br /> toxic-forming spoil for more than 30 days. This decision is based on a <br /> finding that burial or treatment of these materials within 30 days is not <br /> feasible and the delay will not result in any material risk of water pollution <br /> or other environmental damage (4.05.8(3)). See Section 2.04.6 for <br /> identification, mining plan contingencies, and spoil/mine soil <br /> reconstruction plans(respectively)that address acid or toxic spoil horizons. <br /> C. Ground and Surface Water Monitoring <br /> 1. The applicant will conduct monitoring of ground water in a manner <br /> approved by the Division (4.05.13(1)). The ground water monitoring plan <br /> is as follows: <br /> a. The baseline data gathering program (New Horizon 2 - July 1986 to <br /> July 1987) took monthly static water levels and quarterly water quality <br /> samples in January, April,July and October. Results are discussed and <br /> tabulated in Section 2.04.7 of the permit application. <br /> b. All wells in the New Horizon Mine 2 area will be monitored monthly <br /> for water levels adjusted to MSL and samples will be collected <br /> quarterly for water quality parameters with the exception of wells 13, <br /> 14 and 15 which will be on a semi-annual basis. <br /> c. No springs or seeps have been discovered at New Horizon Mine 2. <br /> 17 <br />
