Defendants filed their Motion to Dismiss or in the <br /> Alternative for Summary Judgment on April 10, 1979, and under <br /> Local Rule 20, the Memorandum Brief in support of such <br /> motion is to be filed on April 20, 1979. <br /> 2. The supporting affidavit of Mr. Hark Heifner, an <br /> employee of the Colorado Mined Land Reclamation Division, is <br /> to be submitted in support of Defendants' I9otion and Memo- <br /> randum Brief. <br /> 3. Mr. Heifner has been on an inspection tour in Grand <br /> Junction, Colorado for the entire week of April 14-21, <br /> 1979, and Defendants have consequently been unable to obtain <br /> Mr. Heifner' s affidavit.
