The updated legal, financial and compliance information is <br />acceptable and will be incorporated into the permit. <br />2. The Division was unable to determine exactly why sod and bunch <br />grasses were specified by the Division during the initial <br />permitting of the Blue Ribbon Mine. In fact, it probably <br />would make more sense to utilize more sod formers than bunch <br />grasses on this steep slope area. You are correct in pointing <br />out that species type, cover and seasonality, not growth <br />habits, are the criteria most often used in developing <br />diversity standards. Therefore, removing the growth habit <br />criteria is acceptable. The Division will approve the revised <br />species diversity standard as presented in the revised permit <br />pages. <br />It was noted in Steve Shuey's April 21, 1992 review of the <br />1991 vegetation monitoring report that he recommended <br />combining more of the riparian area with the grassland area <br />would be beneficial in helping to meet all of the standards <br />and would probably reflect the pre-mining situation more <br />accurately. The Division believes it would be appropriate to <br />entertain this action if you care to pursue it further. <br />3. Revised Exhibit Z is acceptable. However, page 124a should be <br />updated to reflect the monitoring plan on Hubbard Creek. <br />4. It is true that the monuments have not been effected by three <br />surficial slides. Each landslide was a relatively small <br />failure which effected a middle portion of the facial slope of <br />
