<br /> <br />2.05.6 Mitigation of Surface Coal Mining Operation Impacts <br />(1)(a) Air Pollution Control <br />The Operator prepared and implemented a Fugitive <br />Particulate Emissions Control Plan for the Elk Creek aurface <br />facilities. The plan, dated March 27, 1991, approved and amended <br />by a letter from the Department of Health dated April 18, 1991, <br />is contained in Appendix C. <br />The mine has an emissions permit for the Bayco <br />Bake-Out Oven that was installed in 1979. A copy of the permit <br />is included with the plan. <br />(b) The Operator obtained an emissions permit for the <br />Sanborn Creek Mine, Permit No. 90GU194, issued November 19, 1990 <br />for the coal mining facility located one mile east of Somerset, <br />Gunnison County, Colorado <br />(2) Fish and Wildlife Plan <br />(a) (i) The surface operations and disturbed areas at the <br />Sanborn Creek Mine will have a minor impact on wildlife (see page <br />2.04-81). The conveyor from the Sanborn Creek facilities to the <br />Elk Creek facilities will be designed with underpasses to allow <br />unimpeded deer movements through the area. The design of the <br />deer underpasses is shown on drawing 5-015. <br />The surface operations and disturbed areas at <br />Somerset Mine have been in place for a number of years and the <br />impacts on wildlife in these areas have already occurred and are <br />considered minor (see letters from the Division of Wildlife dated <br />January 1978 and July 16, 1980). The Operator will minimize <br />future disturbances and adverse impacts through: <br />(1) The Operator will work with the Division of <br />Wildlife in the development of plans for any increase in surface <br />disturbed areas or change in operating plans in these areas to <br />minimize disturbances and adverse impacts to wildlife. <br />(2) The Operator will report promptly to the <br />Division the presence in the permit area of: <br />(a) <br />plant species listed or <br />State. <br />(b) <br />or endangered animal o~ <br />listed by the Secretary <br />Any threatened or endangered animal or <br />proposed to be listed by the Secretary of <br />Any critical habitat of any threatened <br />plant species listed or proposed to be <br />of State. <br />2.05 - 41 <br />Rev. 4:8-08-91 <br />
