Page 1 <br />Construction Mate s Rule 1 <br />RULE 1: GENERAL PROVISIONS AND RE UIREMENTS - ERMIT <br />PROCESS <br />to3 1.1 DEF11vITIONS <br />(1) "the Act" refers to the Colorado Land Reclama on Act for <br />the Extraction of Construction Materials, Section 34-32.5-1 1, et seq., <br />C.R.S. 1984, as amended. <br />(2) "Activi "for the purpose of protecting groundw er quality, <br />means any mining, storing, disposing, or processing operati s, or any <br />reclamation operation or process that may discharge or cause charge of <br />pollutants to groundwaters. <br />tos(r) (3) "Affected Land" means the surface of an area wi 'the state <br />where a mining operation is being or will be conducted, whit surface is <br />disturbed as a result of such operation. Affected lands include b t shall not <br />be limited to private ways, roads, except those roads excluded ursuant to <br />Subsection 3.1.10, and railroad lines appurtenant to any such area; land <br />excavations; exploration sites; drill sites or workings; refuse b or spoil <br />piles; evaporation or settling ponds; work, parking, storag or waste <br />discharge areas; and areas in which structures, facilities, a uipment, <br />machines, tools or other materials or property which result from rare used <br />in such operations are situated. All lands shall be excluded would be <br />otherwise included as land affected but which have been re laimed in <br />accordance with an approved plan or otherwise, as may be app ved by the <br />Board. Affected land shall not include off-site roads which exis prior to <br />the date on which notice was given or permit application was ade to the <br />office and which were constructed for purposes unrelated to th proposed <br />mining operation and which will not be substantially upgraded to support <br />the mining operation. <br />tos(t.s) (4) "Ag 'eved" means suffering actual loss or inju , or being <br />exposed to potential loss or injury, to legitimate interests. Su h interests <br />include, but are not limited to, business, economic, aesthetic, go ernmental, <br />recreational, or conservational interests. <br />(5) "Ambient Groundwater Quality" for mining perations <br />permitted prior to January 31, 1994, ambient groundwater q ity shall <br />mean the quality of the groundwater at the mine site as of J nuary 31, <br />1994. For mining operations permitted on or after January 31, 1994, <br />ambient groundwater shall mean the quality of groundwater at a time of <br />submittal of the permit application. In establishing ambient undwater <br />quality, an Operator or Applicant shall use available or collect <br />
