RULE 1: GENERAL PROVISIONS AND RE UIREMENTS - ERMIT
PROCESS
to3 1.1 DEF11vITIONS
(1) "the Act" refers to the Colorado Land Reclama on Act for
the Extraction of Construction Materials, Section 34-32.5-1 1, et seq.,
C.R.S. 1984, as amended.
(2) "Activi "for the purpose of protecting groundw er quality,
means any mining, storing, disposing, or processing operati s, or any
reclamation operation or process that may discharge or cause charge of
pollutants to groundwaters.
tos(r) (3) "Affected Land" means the surface of an area wi 'the state
where a mining operation is being or will be conducted, whit surface is
disturbed as a result of such operation. Affected lands include b t shall not
be limited to private ways, roads, except those roads excluded ursuant to
Subsection 3.1.10, and railroad lines appurtenant to any such area; land
excavations; exploration sites; drill sites or workings; refuse b or spoil
piles; evaporation or settling ponds; work, parking, storag or waste
discharge areas; and areas in which structures, facilities, a uipment,
machines, tools or other materials or property which result from rare used
in such operations are situated. All lands shall be excluded would be
otherwise included as land affected but which have been re laimed in
accordance with an approved plan or otherwise, as may be app ved by the
Board. Affected land shall not include off-site roads which exis prior to
the date on which notice was given or permit application was ade to the
office and which were constructed for purposes unrelated to th proposed
mining operation and which will not be substantially upgraded to support
the mining operation.

exposed to potential loss or injury, to legitimate interests. Su h interests
include, but are not limited to, business, economic, aesthetic, go ernmental,
recreational, or conservational interests.
(5) "Ambient Groundwater Quality" for mining perations
permitted prior to January 31, 1994, ambient groundwater q ity shall
mean the quality of the groundwater at the mine site as of J nuary 31,
1994. For mining operations permitted on or after January 31, 1994,
ambient groundwater shall mean the quality of groundwater at a time of
submittal of the permit application. In establishing ambient undwater
