For ease of review, the new or revised text has been added to the permit <br />pages in bold red text while tent proposed for removal has been identified in streagk <br />format. While the revision was required to address the Division's concern regazding the <br />potential lack of jurisdiction over certain portions of the Carbon Junction Mine permit <br />area, it remains our position, based on the October 8, 2002 Coal Mining Permit-Technical <br />Revision Decision that there has never been an approved change to the permit area or a <br />reduction of liability for the coal mine. For this reason, this technical revision only <br />proposes to expressly identify the Carbon Junction Mine permit area as the former 215.08 <br />acre permit area approved prior to submittal and processing of Technical Revision 11, and <br />to clarify the text with regard to features and reclamation within the 215.08 acre permit <br />area. <br />The bulk of changes made in TR 11 were required as abatement for a notice of violation, <br />and we contend that to reverse those changes would negate our compliance with the <br />abatement terms. Further, the majority of the changes contained in TR I 1 addressed the <br />current state of the mining operation, as well as plans for reclamation. We propose to <br />retain these approved changes to the mining and operation plan text. <br />Mr. Hernandez and Mr. Beny requested a change to the post-training land use in this <br />revision. We will not propose such a change as the current post-mining land uses aze <br />valid, reflect the proposed post-mining land uses planned for, and to a degree, already <br />executed, and were approved by the Division previously in Technical Revision 5. <br />
