ASSUMED THAT ANY ACTON TO BE TAKEN ON YOUR PART WOULD FOLLOW FROM MY <br />TELEPHONE CALL TO YOU EARLIER IN THE SUMMER CONFIRMING THAT THE MINING OPERATION HAS <br />EXPANDED OUTSIDE OF THE ORIGINAL BOUNDARIES ( PERFORMED A PACE AND COMPASS SURVEY <br />ON THE MINING PROPERTY AFTER YOU SENT ME THE ORIGINAL MINE PLAN MAP) BY THE 2.7 ACRES <br />THAT WOULD INCLUDE DISTURBED GROUND USED FOR TRUCK TURNING ON THE EAST END OF THE <br />PROPERTY NEAR THE SCALES AND MOSTLY ON THE WEST END OF THE MINING AREA WHERE <br />CRUSHER STOCKPILES AND ASPHALT MIXING EQUIPMENT WAS POSITIONED DURING THE 994 <br />HIGHWAY REPAVING PROJECT. THERE IS APP. 2.S ACRES OF GROUND ON THE WEST END OF THE <br />PROPERTY THAT WAS USED FOR STORAGE OF HIGHWAY GAURD RAIL POSTS AND RAILING UNTIL <br />THEY WERE INSTALLED IN 1994 AND EOUIPM ENT AND HIGHWAY CONSTRUCTION WORKER AND <br />EQUIPMENT PARKING DURING THE 1994 SEASON. THIS AREA HAS BEEN RECLAIMED VIA TOPSOIL <br />IMPORTED FROM A NEARBY US SO RIVER PARK CONSTR UCTON PROJECT, SEEDED AND MULCHED <br />AS DESCRIBED IN THE PERMIT APPLICATON DOCUMENT. IN FACT. THE OPERATOR, MIKE TEZAK, <br />HAS RECLAIMED AREAS BOTH EAST AND WEST OF THE CURRENT MINING ZONE THAT INCLUDED OLD <br />HIGHWAY DEPT. GRAVEL EXITiACTON AREAS AND STOCKPILE AREAS THAT PREDATE THE ORIGINAL <br />198 I PERMIT. I BELIEVE THAT A SITE VISIT WOULD CLARIFY YOUR QUESTIONS CONCERNING THE <br />DISTURBED AREA OUTSIDE THE ORIGINAL PERMIT BOUNDARIES. <br />WOULD ALSO LIKE TO DISCUSS THE PROPOSED SHOP BUILDING SITE WITH YOU. THE OPERATOR <br />IS PLANNING ON BUILDING A SHOP FACILTY TO SERVICE HIS SMALL FLEET OF HIGHWAY <br />CONSTRUCTION EOUIPM ENT, NOT RELATED TO THE MINING OPERATON. ALTHOUGH SOME LOADING <br />AND RIP-RAP PRODUCTION IS PERFORMED BY THE OPERATORS HIGHWAY CONSTR UCT ON <br />Ep UIPMENT, 90% OF ALL MINING IS PERFORMED BY SUB-CON7RACTOR DURING THE HIGHWAY <br />PAVING PROJECT, EVERY FOUR TO FIVE YEARS. WHILE THE ORIGINAL INTENT OF THE OPERATOR <br />WAS NOT TO INCLUDE THE SHOP 6UILDING SITE WITHIN THE AFFECTED LAND BOUNDARIES AND <br />WHILE NEARBY. NOT PART OF THE MINING OPERATON, I WOULD LIKE TO REVIEW THE SHOP <br />
