i <br />• <br />_2_ <br />NOTICE OF VIOLATION <br />based upon these same Findings of Fact and in accordance with <br />C.R.S. 34-32-124(6), the (:olorado Mined Land Reclamation board hereby finds <br />High Plains Stone Company to be in violation of Permit M-90-016, and C.R.S. <br />34-32-116(7>(h) of the Colorado Mined Land Reclamation Act 34-32-100 et sec., <br />C.R.S. 1973 as amended. <br />CEASE AND DESIST ORDER <br />based upon these same Fincings of Fact and Notice of Violation, and in <br />accordance with C.R.S. 34-32-124(2),(6) and (7) the Colorado Mined Land <br />Reclamation Board hereby orders Nigh Plains Stone Co. to: <br />1. Cease and desist from conducting mining operations outside affected land <br />of the South 40 Quarry - Permit M-90-016: in Sections 15 and 21, Township 175, <br />Range 62W, 6th P.M. <br />2. Mail, ~.aithin one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one (1) of <br />this Cease and Desist Order. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />The board, during the Formal Public Herring en Notice of Violation M-32-~~5%. <br />stayed the r?quir?menu for corrective actions until the Nov?mCer 18-1y, 1942 <br />meeting of the Board but accompanied that action with a statement that <br />High Plains Stcnz C:.. should come to an agreement ~.ai*h the 3LM. <br />The Board, during the Fcrmal Public Hearing on Notice of Violacion M-32-05', <br />continued the consideration of civil penalty until the time ~.yhen the <br />/ corrective action had been completzd. <br />
