NOV No. CV-97-012
Dear Mr. Routten:
Stl' 0 3 1997
Division of asnerais t;, Geology
Colorado Yampa Coal Company (CYCC) is requesting an assessment conference with
regard [o the above NOV issued August 1, 1997.
CYCC feels that a seriousness assessment of "significant" as determined by the DMG is
excessive. As noted in a letter to Kent Gorham dated August 8, 1997, the ponds
associated with this NOV are visited regularly by a Registered Professional Engineer,
weekly inspections of Pond A and Pond Dare performed to comply with MSHA
requirements, and the DMG conducted two inspections during the second quarter. No
significant problems were evident prior to the second quarter, nor since the second
quarter.
CYCC completed pond inspections on July 30, 1997 and August 1, 1997. The inspection
forms were mailed on August 1, 1997 and the NOV terminated on August 4, 1997. The
"Time for Abatement" was set as August 31, 1997. CYCC feels that "Good Faith"
should be associated with the abatement of this NOV due to rapid compliance.
Please contact either Rick Mills at (970) 870-2712 or myself at (970) 870-2750 to set up
a date and time for a conference regazding this issue.
COLORADO YAMPA COAL COMPANY
~~
Tavis D.
