..,e , .. ~ <br />•I <br />3 <br />l~ . <br />~.~ia _2- <br />CEASE AND DESIST ORDER <br />Based upon the foregoing Findings of Fact and Notice of Violation, and <br />pursuant to the provisions of C: R.S. 34-32-123, the Board hereby orders you to: <br />Immediately cease and desist all mining operations, with the exception <br />that equipment may be removed, until permit for this site has been <br />obtained. <br />2. Mail, within one (1) day after receipt of this Notice, to the Mined Land <br />Reclamation Board, written notice of your compliance with paragraph one <br />(1) of this Cease and Desist Order. <br />3. Complete the following corrective actions: <br />a. The operator must obtain the appropriate permit for the site, <br />either a reclamation-only permit, 110(2) permit, or 112 permit. <br />b. For reclamation-only, or 110(2) permit, application must be <br />submitted by December 19, 1444, and approved within 60 days of <br />submittal. <br />c. For 112 permit, application must be submitted by December 19, 1994, <br />and approved within 120 days of submittal. <br />4. If the corrective actions are not taken in 90 days, this matter will be <br />brought back before the Board, at which time the Board may impose a <br />civil penalty. <br />This Cease and Desist Order shall remain in effect until all terms have been <br />satisfied by the operator. <br />In clarification of the rights of recipients of Notices of Violation, Cease <br />and Desist Orders, parties are advised to consult the Colorado Mined Land <br />Reclamation Act and the State Administrative Procedure Act. <br />Nothing herein contained, particularly those portions requiring certain acts <br />to be performed within a certain time, shall be construed as a permit or <br />license to engage in any prospecting or mining operations within the State. <br />Persons concerned with judicial review of the provisions of this Order are <br />advised to consult C.R.S. 24-4-106, as amended. <br />~Z <br />Dated at Denver this` day of ~~ ~. <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />MICHAEL B.
