Walther West Regional Service Center Execu"ve Direuor 71 I Independent Avenue ""I`n'el B. ~°ns Dwision Dueclor Grand Junction, CO 81 ~0~ Re: Foidel Creek Mine (Permit No. C-1982-056) Permit Revision Application No. ~ (PR-5) Northern Mining District Permit Revision Dear Wildlife Manager: The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 118, Paragraph 3, of the Colorado Revised Statutes, that on November 29, 1999, an application to revise coal mining operations at the Foidel Creek Mine was considered complete for the purposes of filing. All review and comment periods as provided in the Act and the Regulations initiate from [his date of filing. This revision proposes [he next ~ year mine plan, in a area referred to as [he Northern Mining District. This proposed expansion calls for room and pillar mining and longwall mining. No new surface disturbance is proposed with this revision, other than that associated with underground mine subsidence. The mine plan proposes to affect the Fish Creek and it's associated alluvial valley Floor. The mine expansion will add 2779.2 acres of affected area. The Underground coal mining operation is on land located approximately 23 miles southwest of Steamboat Springs, Colorado. The permit area is further described as follows: In portions of Sections 7, 8, 9, T4W, R86W; Sections 32 and 33, T6N, R86W; Sections 23, 24, 2~, 26, 27, 34, 35 and 36 in TSN, R87W; and all of TSN, R86W with the exception of Sections 34, 35, and 36. The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Rattlesnake Butte. Because the above referenced permit revision application would incorporate additional lands into [he permit area or might otherwise alter previously approved permit conditions or mitigation measures, eve are requesting your agencvs evaluation of the proposal. Your comments and concerns relating to the adequacy of fish and wildlife resources information, the fish and wildlife plan, and the reclamation plan as i[ relates to fish and wildlife considerations, including potential impacts to threatened or endangered species, are requested. Your evaluation of any woody plant stocking levels, planting arrangements, and methods for mitigation of potential adverse impacts is also requested. iiiiiiiiiiiuiii~ 999 Pertinent sections of the permit revision are enclosed. 1n order for us to comply with regulatory time frames, we request that comments be submitted to the Division of Minerals and Geology at the above address by 5:00 p.m. on January 28, 2000.
