February 14, 1990, correspondence to OSM indicated that <br />the Division's course of action would include seeking bond forfeiture <br />or pursuing the land use change. <br />On February 6, 1990, the Division received a letter from the operator <br />requesting that the circumstances of the situation be considered and <br />that bond release be granted. None of the required documentation nor <br />notification for bond release was provided. <br />OSi4 inspected the site again on July 20, 1990, and noted a number of <br />alleged violations. They Contacted the Division and requested to be <br />provided with a schedule outlining the course of action to be taken in <br />order to abate the violations. A hearing was scheduled for the <br />September 1990 Board Ideeting to discuss bond forfeiture. At that time, <br />the Board asked the Division to intervene on behalf of the operator to <br />resolve the access issue with the landowners. Letters from landowners <br />were presented at the November 1990 Board Meeting in which they stated <br />the operator would be allowed to access the site to conduct maintenance <br />activities. An Order was issued directing the operator to complete the <br />maintenance by June 1, 1991, with the Division providing monitoring, as <br />a report to the Board at its June 1991 Board Meeting. <br />Staff reported that the operator has pursued the maintenance activities <br />and continues this effort. Most of the maintenance has been conducted <br />as required by the Order, and that work was discussed by Staff. Items <br />that have not been completed include: replacing a culvert, re-routing <br />some surface drainage and cleaning some sediment ponds. <br />Staff said the operator has made a diligent effort to comply with the <br />Board Order. Therefore, the Division requested that the Board continue <br />consideration of this matter and schedule a hearing for the July 1991 <br />Board Meeting. At that time, the Division would discuss various <br />options regarding final disposition of the pending Board Order. <br />It was MOVED that the Board approve Staff recommendations to continue <br />this matter and schedule a Formal Public Hearing for the July 1991 <br />Board Meeting.
