3. Less than three acres of peat will be extracted to a depth of approximately 18 inches for a <br />total of approximately 7,500 cubic yazds of peat. The excavated peat will be removed from <br />an existing wetland, transported to a receiver site and reassembled in a hydrologically <br />modified basin within the confines of the property. None of the extracted materials will be <br />hauled off-site, and none of the materials will be sold. The Petitioner has consulted with the <br />United States Army Corps of Engineers, the United States Fish and Wildlife Service and <br />Lake County, and none of these governmental entities requires a permit. Public participants <br />in the study include the Petitioner, the United States Army Corps of Engineers, the United <br />States Fish and Wildlife Service, the United States Environmental Protection Agency and <br />the Pueblo Board of Water Works. <br />4. Because the Petitioner's excavation activities aze directed at fen research to be conducted <br />entirely on contiguous property owned by the Petitioner, and because none of the materials <br />will be hauled of sold off-site, it is appropriate for the Board to issue a declazatory order <br />exempting the Petitioner's proposed activities from the requirement of obtaining a <br />reclamation permit. <br />City ofAurora/Rocky Mtn.
