Long <br />Division Director <br />In response to your memo dated September 4, 1996 regarding the disturbance along the <br />Routt County Rd. 27a to the Seneca Coal Company mine office, I would like to clarify <br />details of conversations I had with Mr. Altavilla of Seneca Coal Company regarding this <br />road. <br />Mr. Altavilla first questioned me about Routt County road 27a in the Spring of 1996 in <br />regards to Rule changes, Sections 4.034.1(1)(d) and 4.03.2(1)(f), effective April 1, 1996. Mr. <br />Altavilla asked if County road 27a would require certification under these revised rules. I <br />looked into this question, consulted with other Division staff, and responded to Mr. Altavilla <br />that Routt County rd. 27a is a county road, it is not included in their permit area, it is an <br />existing road used by Seneca Coal Company for access, and SCC did not construct it, so <br />SCC did not have to certify its construction. <br />In August 1996, during an inspection I conducted at the Seneca II Mine, Mr. Altavilla <br />mentioned that SCC may need to cut some of the slope on Routt County road 27a, this was <br />a change from his previous estimate of filling in some ditches and cleaning off some of the <br />sloughed soil material from the cut banks. He asked if cutting the slope on County Road <br />27a would require a permitting action through DMG. My response was, that whenever I <br />had checked into matters involving County Road 27a that it was considered a County road <br />and he should get approval from Routt County, but since he was talking of a significant <br />volume of material he ought to check with Larry Routten of DMG, since Larry had more <br />involvement with the ongoing road issues connected with the Yoast Mine. <br />I hope this memo helps to clarify some of the discussions that DMG has had with SCC <br />regarding Routt County road 27a. <br />
