Materials Rule 1.5. The Board has delegated to the Division the authority to assess civil <br />penalties against permittees who fail to submit annual reports or pay annual fees. <br />3. The Permittee failed to submit an annual report and failed to submit an annual fee of <br />$281.00 to the Division on or before the anniversary date of the issuance of the Permittee's <br />permit. The Permittee at one point submitted a check for the amount of the annual fee, but <br />the check was returned for insufficient funds. On February 4, 2005, the Division issued <br />Notice ofViolation MV-2005-012 for failure to submit an annual report and pay the annual <br />fee. The Division also assessed a civil penalty of $281.00. The Division informed the <br />Permittee that unless the annual report was submitted and the annual fee and civil penalty <br />were paid by March 9, 2005, the Board would hold a hearing on March 16, 2005 to <br />consider permit revocation and financial warranty forfeiture. <br />The Division received no response to its Notice of Violation. The required annual report, <br />annual fee and civil penalty have not been received. <br />Because the Division has not received an annual report, annual fee or civil penalties from <br />the Permittee, and because the Permittee did not respond to the Division's notice of hearing, <br />it is appropriate for the Board to order the permit revoked and the financial warranty <br />forfeited. <br />
