Reclamation kesources <br />should address these concerns as well as those in our May 22, 1490 letter, by <br />no later than June 8, 1990. I would also suggest that other point which were <br />to be stipulated to be resolved by June 8, 1990. <br />1. The pond embankment stability analysis should be reevaluated. The new <br />analysis should be based upon site specific information obtai ed by <br />coring the embankment. Visual observations relating to pond ischaroe <br />along the embankment outslope should also be aoaressed. All ssumptions <br />regarding permeability, porosity, angle of friction, cohesion etc. should <br />be documented in the report. <br />2, Engineering diagrams and cross sections of the embankment ire is <br />reconfigures condition should be submitted. In addition, new pond volume <br />calculations should also be submitted, based upon the reconfi ured <br />embankment. <br />... It has been reported that as much as one cubic foot per secon (CFS) was <br />observed to leak through the embankment. The Act at 34-32-11 (4)(c) <br />requires that an applicant demonstrate compliance with applic ble state <br />and federal regulations. A one CFS discharge through the emb nkment does <br />not appear to comply with the standards of the Clean Water Ac at <br />440.148(b).
