<br /> <br />(5) The Cedar Heights property owners should install a culvert <br />in the location of 'proposed culvert "A" as shown in the <br />CAP. The size of this culvert will be dependent upon the degree <br />of street maintenance the property owners feel is acceptable to <br />keep Cedar Heights Drive free from sediment. At a mimimum, it is <br />recommended that the culvert be no smaller than a 24-inch <br />corrugated metal pipe. <br />ib) The operators of the quarry should provide the owners of the <br />Cedar Heights property with assurances that they will maintain <br />the safety berm and the area upstream of the HR-6 outfall point <br />for sufficient period of time to allow for natural vegetation to <br />develop and therebylimit the amount of sediment available for <br />transport into the natural Swale through the Cedar l~leights <br />property. <br />(7) Should options 1 through 5 be considered for implemen•~ation, <br />the quarry operator should be responsible for the stabilization <br />of the roadside swales and the safety berm to the satisfac~=ion of <br />the Cedar Heights property owners. Since these options would <br />involve the diversion of flow from its historic path, it is <br />recommended that the Cedar Heights property owners not )provide <br />any hold harmless provisions to the quarry operator. The quarry <br />operator should be held responsible for the long-term <br />maintenance of the facilities, and should be responsible ~`or any <br />~l damages resulting from runoff and erosion which might occur in <br />4f the vicinity of the guard house and at the inlet and out.~et of <br />the 54/30-inch culvert under Black Canyon Road. <br />Kiowa will remain available to meet with the representatives of <br />the Cedar Heights property owners to discuss and clarify our <br />recommendations.
