Helmricks <br />400 E. 32nd Street <br />Durango, Colorado 81301 <br />RE: Your unpermitted mining operation located in Sec. 33, T34 1V2N, R9W of <br />the N.M.P.M., La Platta County, Colorado <br />Dear Mr, Helmricks: <br />It has come to our attention that you are conducting an unpermitt mining <br />operation at the above-described location. Enclosed please find copy of the <br />report of our reclamation specialist, Gregg Squire's inspection of your <br />operation. This inspection occurred on December 12, 1984. <br />All mining operators are required to obtain mining and reclamatio <br />their mining operations in Colorado by the Colorado Mined Land Re <br />Act, C.R.S. 34-32-101 et seq., and specifically, 34-32-i,p4(7j., as <br />The Mined Land Reclamation Division has placed you and your tipera <br />Mined Land Reclamation Board meeting agenda for consideration of <br />violation of the above mentioned statute. This meeting is schedu <br />January 23-24, 1985, in Room 110 of 1313 Sherman St., Denver, Col <br />commencing at 9:00 a.m. each day. Your matter will be heard as s <br />commencement as possible. Please call this office during the per <br />January 21-22, ]985 for a more specific day and time. <br />At the meeting the Board may issue a Cease and Desist Order for <br />at the above cited location per Article 32 of Title 34, Section <br />states: <br />permits for <br />amation <br />on on the <br />possible <br />d for <br />ado, <br />n after <br />d of <br />operation <br />(1) which <br />(1) "Whenever an operator or prospector fails to obtain a vali permit or <br />file a notice of intent under the provisions of this article, the board <br />may issue an immediate cease and desist order. Concurrentl with the <br />issuance of such an order, the board may seek a restrainin order or <br />injunction pursuant to Section 34-32-124(3)". <br />At a formal public hearing, to be held during a later Board meeti g, the Board <br />may consider possible civil penalties (if a violation is found).
