Carboy <br />Division Directs <br />Natural Resource Trustee <br />The Division of Minerals and Geology (DMG) has received your letter of December 22, 2005 stating <br />Chaffee County's objections to DMG consideration of the application until Mr. Van Ella has applied for a <br />County Special Land Use Permit. The letter also requests that any DMG approval include a condition that <br />Chaffee County Land Use approval be received prior to beginning any operations or issuance of the permit <br />(amendment in this case). <br />We have forwazded your objection letter to the operator for their response and consideration. <br />The DMG is scheduled to issue its decision on the amendment application on or before January 11, 2006. <br />Any person directly and adversely affected or aggrieved by the DMG's decision to grant or deny the 110 <br />Limited Impact Permit Amendment application and whose interests are entitled to legal protection under <br />the Mined Land Reclamation Act may appeal the DMG's decision to the Mined Land Reclamation Boazd <br />pursuant to Rule 1.4.11, 2 CCR 407-1. <br />If you have any questions or need further assistance, please contact me at 303-866-3863. <br />ceFely, . <br />azl B.
