Cattany <br />Division Director <br />Natural Resource Trustee <br />The Division of Minerals and Geology received February's monthy status report from BTU Empire <br />Corporation (formerly known as RAG-Empire, prior to the name change as registered with the Colorado <br />Secretary of State's Office) on February 22, 2005. This monthly status report also requested that the <br />Division extend the proposed decision date for Permit Renewal No. 4. It is our understanding from your <br />letter received February 22, 2005, that BTU-Empire did not suggest a specific extension date due to the <br />ongoing litigation involved with a right of entry matter between the operator and landowners within the <br />permit boundary. The Division will grant an extension of the proposed decision date for Permit <br />Renewal No. 4 until Apri129, 2005.
