Box 285 <br />Mesa, CO 81643 <br />RE: Nichols Gravel Pit, Conversion Approval, Permit No. M-81-013, Revision No. CN-2 <br />Dear Mr. Nichols: <br />On September 22, 1999 the Division of Minerals and Geology approved the Conversion application <br />submitted to the Division on May 26, 1999, addressing the following: <br />Operator is approved to expand permitted acreage and extend pit toward the east. Conventional <br />mining on maximum of 50' deep will result in a pit to be reclaimed as wildlife habitat and farmland. <br />Operation may expose seasonal irrigation return flows as seeps by adjacent domestic wells are not to <br />be adversely affected. <br />The terms of the Conversion No. 2 approved by the Division are hereby incorporated into Permit No. <br />M-81-013. All other conditions and requirements of Permit No. M-81-013 remain in full force and <br />effect. <br />The estimated liability amount of $39,132.00 for the Nichols Gravel Pit, when added to the existing <br />liability amount of $14,300.00, exceeds the performance bond held. If you have not already done <br />so, please submit additional bond in the amount of $24,832.00.
