Also <br />enclosed is a modification form for NOV C-94-012, to exclude the Northwest sediment trap. <br />During the Board hearing, the Board upheld the original amount of the assessed penalty <br />$750.00), and not the penalty resulting from the assessment conference ($500.00). Since Sun <br />oat Company declined the settlement agreement offered as a result of the conference, and <br />elected to pursue the matter with the Board, the penalty of $500.00 (aheady paid by Sun Coal <br />Company) no longer applies.
