STATE OF COLORADO <br />MINED LAND RECLAMATION BOARD <br />DEPARTMENT OF NATURAL RESOURCES <br />IN THE MATTER OF: Colorado Mining/Smelting, It[C. )NOTICE OF VIOIe1TION MV-97-002 <br />P.O. Box 2428 ) AND <br />Dillon, CO 80435-0000 ) CEASE AND DESIST ORDER <br />TO: Colorado Mining/Smelting, Inc. and all other persons engaged in or owning or controlling the following <br />operation: Stillson Patch, M-90-040. <br />FINDINGS OF FACT <br />Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Board by C.R.S. 34-32-124, <br />the Board hereby makes the following findings of fact: <br />Colorado Mining/Smelting, Inc. has conducted a mining operation at the following location: Section 32, <br />Township 6.5, Range 77.W, 06th Prime Meridian, in Summit County, Colorado. <br />2. The Mined Land Reclamation Board conducted a Formal Public Hearing on February 26, 1997 to <br />consider possible violation of C.R.S. 34-32-101 et seq_ <br />3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on February 26, <br />1997, demonstrating that: <br />Colorado Mining and Smelting has not obtained a permit for mining operations at the Stillson <br />Patch as required by C.R.S. Section 34-32-101 et.seq. <br />NOTICE OF VIOLATION <br />Based upon these same Findings of Fact and in accordance with C.R.S. 34-32-124(6), the Colorado Mined Land <br />Reclamation Board hereby finds Colorado Mining/Smelting, [nc. to be in violation of C.R.S. 34-32-109(7). <br />This section provides in pertinent part: <br />An operator shall obtain a reclamation permit from the Board for each mining operation. <br />The term "operator" is defined in C.R.S. 34-32-103 to include: any person, firm, partnership, association, or <br />corporation, or any department, division, or agency of federal, state, county, or municipal government engaged <br />in or controlling a mining operation. <br />
