<br />that GJP may have prepared shall be given to Lessor, upon his request. Lessor shall <br />' cooperate with and assist GJP in the prosecution of the Water Rights Application. GJP shall <br />be entitled to utilize, without charge, any water rights so adjudicated for evaporation, <br />reclamation purposes, dust suppression, product moisture losses, aggregate washing, or other <br />' uses needed in its operations on the Property during the term of this lease, and any <br />augmentation or replacement plans which may have been approved. <br />B. After execution of this Lease, GJP shall also apply for a well permit from the <br />Colorado State Engineer's office for the mining of the Property under this lease (the "Well <br />Permit"), at its sole cost and expense. The application shall be filed in the name of GJP, as <br />the lessee under this lease. <br />' C. After the expiration ofthe lease term or other termination of this lease, GJP <br />shall assign all rights and obligations under the Well Permit, all water and water rights, <br />including any lakes or pools that may be left on or with the Property as a result of GJP's <br />' mining, and all augmentation and replacement plans to Lessor. Thereafter, GJP shall have <br />no further interest in or obligations under such Well Permit, water, water rights, or any <br />augmentation or replacement plans, except to the extent they are needed for the proper <br />' reclamation of the Property, in which case Lessor agrees that they can be used for <br />reclamation purposes. <br />' 8. Lessor warrants title to the Property and to all sand, gravel, and similar materials <br />located on the Property, acid further warrants and covenants that GJP shall have the right to extract <br />' sand, gravel, and similar materials from the Property and otherwise use and occupy the Property as <br />' set forth in this lease without interference from any person. This warranty does not apply to any <br />permit conditions or other governmental conditions or approvals that GJP must have or meet to <br />conduct its operations on the Property under this lease, compliance with which are GJP's sole <br />' obligation and responsibility. <br />9. Lessor shall pay all real property taxes and special assessments relating to the <br />Property which may be imposed or incurred during the term of this lease.
