District 23 <br />Dear Mr. Ducommun: <br />We have reviewed yqur September 24, 1998 request for an extension tp the current <br />substitute water supply plan that allows an alternate point of diversion to the re erenced <br />Columbia No. 1 ditch. The ditch is used for placer mining purposes. The atte ate point of <br />diversion is located about 2 1/2 miles downstream from the current decreed ( se no. 1636, <br />District Court of Park County) location.. Water will be diverted from the river al he allemate <br />point of diversion by means of a pump. <br />This substitute water supply plan is hereby approved pursuant to Secli¢n 37-80-120, <br />C.R.S., subject to the following conditions: <br />1. Diversions through the alternate point shall be limited to the lesser of 5 cfs r the flow <br />available at the original headgale. The total instantaneous diversion from ~ <br />oth the <br />Columbia No. 1 Ditch and this new alternate point of diversion shall not ex eed 27 cfs. <br />2. Measuring devices must be installed in the river at the original head gate d the <br />alternate point of diversion. These devices must be satisfactory to the Divi Ion Engineer <br />and the Water Commissioner. Alternatively, if acceptable to the Water Co missioner <br />and Division Engineer, the measuring device to determine flows in the ditc may be used <br />in lieu of the river measurement if water is turned back to the river. All rec rds must be <br />submitted to the Water Commissioner and the Division Engineer on a wee ly basis when <br />the flow above Columbia Reservoir is near or below 5 cfs because of the I' it on <br />diversions discussed in Condition 1. Otherwise, flow records shall be sub Illed monthly. <br />3. In order for our office not to require evaporation replacement, we would a k that you <br />provide information that confirms that the historic phreatophyle vegetation ~ <br />evaporation <br />equals present evaporation from the reservoir. If this is the case, no evap ration release <br />will be required. <br />4. Use of the water diverted from the alternate point is limited to placer minin~q. Granting of <br />this approval does not imply approval of the application filed in Division 1 ater Court <br />Case No. 96-CW-149. <br />
