This
proposal is based on discussions at the assessment conference held on
October 11, 1984 in our offices. In attendance at that conference in addition
to me were Oreg Lewicki and Bruce Baker representing Trinidad Basin Mining and
Jim Herron and Brian Munson representing the Division staff. If you agree
with the proposal please sign it and return to our office as instructed on the
form. If you disagree and wish to be heard before the Board you may do so as
outlined in the regulations.
The proposal basically does two things; 1) the abatement period has been
changed to reflect a more realistic deadline and 2) the civil penalty has been
proposed at the minimum $750.00 per day. If you have any questions please do
not hesitate to contact me.
Sincerely,
David C. Shelton
Director
DCS/eas
Doc.
