These responses were prepared by ACZ, Inc. and are <br />based upon a review of the stated CMLRD concerns, a review of applicable CMLRD <br />regulations and guidelines and several conversations between yourself and Jerry Nettleton. <br />The enclosed information is submitted in support of Rockcastle's November 30, 1990 bond <br />release request and pursuant to Section V of the June 26, 1990 Agreement between <br />CMLRD and Rockcastle (the "CMLRD Agreement"). This information is also submitted <br />to support a Phase I bond release for the entire site and a Phase II bond release for all <br />areas of the site, except the part of Pit 4 reclaimed in 1990. Rockcastle believes that the <br />attached information fully documents and describes the reclamation activities completed at <br />the site and that CMLRD may proceed with the bond release solely on the basis of this <br />information pursuant to § V.1 of the CMLRD Agreement. <br />The bond release process set forth in the CMLRD Agreement is based solely upon <br />completion of specified reclamation activities at the Grassy Gap site. Certain bond amounts <br />are to be released following completion of each specified reclamation activity, CMLRD <br />
