Director <br />January 8, 1987 <br />Mr. Sam Arness <br />Arness-McGriffin Coal Company <br />1200 Florida Road, M-52 <br />Durango, Colorado 81301 <br />Re: Arness-McGriffin Mine Reclamation <br />File No. 77-3-UG (and C-81-042) <br />Dear Mr. Arness: <br />The purpose of this letter is to recap the discussion and agreements reached <br />during our meeting today (January 6), <br />In 1979, the Colorado Mined Land Reclamation Board issued two cease-and-desist <br />orders to your company. These orders r+ere issued for conducting mining <br />operations outside of the approved permit area and for conducting surface <br />mining activities when only underground mining activities were approv-~ In <br />an attempt to abate these cease-and-desist order, Arness-McGriffin Coal <br />Company submitted an application under the permanent regulatory program, File <br />C-81-042. Due to a lack of information, this application was deemed <br />incomplete by the Division. No additional information was ever received from <br />Arness-McGriffin Coal Company, therefore, this application remains incomplete. <br />Peerless Resources, Inc. submitted an application to mine coal via underground <br />mining in this area in 198. This application, C-84-067, encompasses the <br />majority of the areas previously disturbed by the Arness-lQcGriffin Coal <br />Company. The purpose of today's meeting was to discuss the continuing <br />reclamation liability of lands disturbed by the Arness-McGriffin Coal Company <br />not agreed to be reclaimed by Peerless Pesources, Inc. This area is the <br />hiohwall and associated fill identified as Area II in File C-81-042. <br />In order to satisfy the reclamation obligations of the previous permit, <br />i7-3- UG (of which the Division still holds a $13,700.00 bond), and of the two <br />outstanding cease-and-desist orders, it is necessary to reclaim the disturbed <br />lands of Area II. To this end, three different proposals were identified by <br />your consultant, i^r. Fred Johnson: <br />1. Backfill the exposed hiohwall with the fill material to a stable <br />37oslope; <br />2, Recontour the exposed highwall by drilling and blasting; or <br />3, Plant trees in front of the exposed hiohwall to act as a visual barrier, <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
