Minmzs-October 2l. 19)8 pace dg
Wz have a very effective dwt suppression program which we have to and do lollow m place. So
I have no further comments really. !t's all worked out. The pond is in place. Everything seems to be fine.
JAVERNICK: Questions for Mr. Frez. You are in agreement with the stipulation that Mr. Dillie
read as part of your permit'?
FREE: Yes, I'm in agreement with that. 1 just have one comment For Ivlr. Dillie here. The bond
that is in place, which was, in tact, increased after succession of our operator does take into
consideration the cost of refilling of the pit upon completion. Most of the pit we have already done.
DILLIE: There's sufficient funds in the curzem bond to complete backfilling of the pits.
FREE: In this case, we as the operator would not do it. This is in progress and is partially done
already.
JAVERNiCK: Anything else? Close testimony.
COHAN: Are there any comments from the door?
IAVERNICK: I don't have any requests From anybody From the t7oor. Any other discussion
amongst the board'? I'll entertain a motion.
COHAN: Mr. Chairman, I will make a motion in the matter of File Number M-83-084,
Snowstorm Sand and Gravel, that we approve the application with the previously discussed stipulation
regarding the compliance with water laws or backfilling. ,~
PAULIN: I'll second that.
JAVERNICK: We have a motion made and seconded that we approve the permit File Number
M-83-084 with the stipulation as outlined by staff. All in favor.
THE BOARD: Aye.
JAVERNICK: Permit is approved.
DILLIE: Thank you very much.
FREE: Thank you.
LONG: Mr. Chairman, three things. First of all, on behalf of the staff and myself I would like to
thank Bill for the work he did in November with preheating conferences. He's become an honorary ALJ
or something doing all the conferencing he's been doing.
Second thing is' [asked Mark Held to stay. He was introduced. He will be your attorney. I asked
him to say just [o see if there's anything you would like to say to him as a board, or he would like to say
to you, or if there's any particular projects that you have in mind that you would like him to start working
on. He's now available and at your service. So, Mark, if you wan[ to address [he board, come on up.
HELD: [guess 1've met most of you. I haven't met Catherine. My name is Mark Held.
CATTANY: Hi.
HELD: Assistant attorney general, and I'd be happy to entertain any questions you have about me
or entertain any thoughts you have about things you'd like to do.
COHAN: Not only that, he's got a graduate degree in geology.
CATTANY: Yeah, but from where?
PAULIN: Barbara kind of wanted to be involved. Is she down in somebody's office?
LONG: Yeah. We can go get her.
IAVERNICK: What we hoped to do either today or tomortow when we finished all the agenda
items was sit down with Mark and discuss the future relationship and how we would like --just the types
of thtngs you talked about, and you'll be here tomorzow also.
We have another agenda item here that Glenda has given me.
WiLLIAMS: No. Actually that item is a Sunshine For Environmental recovery, and as 1
understand it, depending on how you act on that item, three more items may or may not need to be
heard, and it looks like you may be able to get through your agenda this afternoon. So you may not need
to meet tomorzow.
HELD: We can discuss whether I'd be here tomorrow.
JAVERNFCK: Yeah, We'll get Barbara back up here.
CATTANY: But if we're not here, you'll be very lonely.
LINDEN: One suggestion f would make is that iFyou all have projects or have suggestions on
how you want to establish this relationship with your attorney, you could probably funnel it through one
of the board members or through Mike, but I was Just thinking that this is a public meeting that you'll
have since all of you are going to be here. So it will have to be a public meeting.
UNIDENTIFIED SPEAKER: Unless you consider it an executive session for litigation sensitive
