5. All but one objector withdrew their objections after the Informal Conference. <br />6. The remaining objector did not attend the Pre-hearing Conference nor did he appear at the <br />November I8, 1998 Board hearing. <br />7. Mr. Dillie testified that the issues raised by the objectors, that were within the jurisdiction of <br />the Division and Board, were abated or addressed by the permit amendment applicant. The <br />Division recommended that the Board approve the permit amendment application with one <br />condition; the Operator must comply with applicable State water laws or backfill the mined <br />pit. A sufficient bond will be required to backfill the mined pit in case of permit revocation <br />and bond forfeiture. If water rights issues are resolved, and the Operator intends to leave a <br />pond as part of the reclamation plan, the Division will approve the plan since a pond is <br />compatible with the post-mining land use. <br />ORDER <br />Based on the above Yindings of fact and conclusions of law, the Board: <br />1. APPROVES Snowstorm Sand & Gravel LLC's application to amend permit M-1983- <br />084 with one condition. The Operator must comply with applicable State water laws or <br />backfill the mined pit. A sufficient bond will be required to backfill the mined pi[ in case of <br />permit revocation and bond forfeiture.
