Approval of the <br />amendment application included one condition; the Operator must comply with applicable State <br />water laws or backfill the mined pit. A sufficient bond will be required to backfill the mined pit <br />in case of permit revocation and bond forfeiture. If water rights issues are resolved, and the <br />operator intends to leave a pond as part of the reclamation plan, The Division will approve the <br />plan since a pond is compatible with the post-mining land use. <br />If you have any questions, please contact James Dillie at 303-866-4060. <br />Sincerely, <br />Michael B.
