The residenla and properly <br />owners greatly appreciate your enforcement actions to protect our private property righr:: <br />vul values. <br />On the other hand, on October R, 1991, .C had a lengthy conversation with President. <br />Ted Strickland, Colorado State Senate, about the 1977 Flining Act. PresidenC Strickland, <br />who sponsored the Act, said and I quote, "The 197J Mining Act amended tits 1963 Act to <br />prnvJde fora legal definition of Commercial Mineral Deposit to include sand and gravnJ <br />a~ld quarry aRQreRate. This was done so that mineral owners do not have Co litigate <br />=ami and gravel rights as being ini:luded under the general reservation of minerals.". <br />President Strickland, the Josepite heirs, myself and others are deeply disF.ressed <br />thaC the 1•ILRB, on the advice of Che Attorney General's office, refused to rule on this <br />matter. We respectfully request that the MLRB reconsider their position on wheCher or <br />not Elbert County is permitted to continue mining operations at Fondis, while owning <br />on1.y 1%2 of Che minerals. <br />The Concerned Citizens of Fondis also respectfully request that if or when Elbert. <br />County requests an expansion of this pit that they be made to comply with Vol. 7.4, <br />title 34, Art. 46, Sec. 102, Master Plan for ektract.ion. Incidentally, following <br />t:he Augvst 21, 1991, MLRB public hearing the Elbert County representatives suggested a <br />meriting with Plaintiffs to address our concerns and claims.
